The Woodlands attorney Morgan Bourque was indicted on a third-degree felony charge of aggravated perjury, accused of entering false evidence in a 2023 DWI trial.
Morgan Bourque, a criminal defense attorney from The Woodlands, faces an indictment for aggravated perjury concerning a video he presented as evidence during a driving while intoxicated trial in 2023.
A Montgomery County grand jury indicted Bourque on October 14. On October 17, he was taken into custody in Walker County and released that same day after posting a $3,000 bond, as indicated by court records. In Texas, aggravated perjury is classified as a third-degree felony, which carries a potential prison sentence ranging from two to ten years.
The charges arise from Bourque’s defense of a Montgomery individual accused of driving under the influence after a crash that occurred in December 2020 within the exclusive Bluejack National community. During the trial, Bourque presented a video he claimed to have recorded at the scene. Under oath, a paralegal from his firm testified that she had filmed it.
Prosecutors claim that the statement was untrue. The indictment alleges that the paralegal failed to record the video and identifies her as a co-defendant, even though she was not indicted.
Bourque and the paralegal were unavailable for immediate comment via the law firm.
The case is now being prosecuted by the Fort Bend County District Attorney’s Office, following the Montgomery County District Attorney’s Office's decision to recuse itself due to previous professional connections with Bourque.
“In specific instances where fairness or impartiality might be in doubt, our office aims for recusal,” stated First Assistant District Attorney Mike Holley. “This may happen when there is a genuine conflict of interest, or even the perception of one.”
Bourque and his father, Gerald Bourque, run their criminal defense practice in The Woodlands. The firm’s website indicates that Bourque has an extensive background, having previously collaborated with the U.S. Attorney’s Office, the Department of Justice, the Southern District of Texas, and the district attorney’s offices in Harris and Montgomery Counties.
The investigation is ongoing, and a trial date has not yet been set.
