A Harris County assistant district attorney has been terminated from his position following felony assault charges related to family violence—specifically strangulation. The charges arise from an alleged incident that occurred on Sunday during a child's birthday party in Montgomery County.
At approximately 5 p.m., authorities took Gabriel Kabak, 32, into custody. On Sunday, authorities reported that Panorama Village police responded to a disturbance at a residence hosting a birthday party.
A news release from the Panorama Village Police Department states that Kabak is facing allegations of becoming physical during a dispute with a woman who expressed concern over his ability to drive home safely while intoxicated. A woman reported to authorities that Kabak allegedly pushed her, forced her against the side of a home, and grabbed her by the throat, resulting in pain and a temporary inability to breathe.
Authorities reported that attendees at the gathering tried to separate Kabak from the woman and children prior to the intervention of law enforcement officials. The Montgomery County Sheriff’s Office sent a Panorama Village officer to the location, with a unit from the Texas Game Warden also arriving at the scene.
Prior to the alleged assault, authorities reported seeing Kabak pushing other attendees. The release claims that Kabak identified himself as an assistant district attorney in Harris County during his arrest and made several unsolicited statements.
A man was taken into custody and booked into the Montgomery County Jail just before 8:30 p.m. on Sunday evening. According to police reports, a magistrate has set a bond of $35,000. The status of whether Kabak has secured legal representation remains unclear at this time.
As of Monday, Kabak has officially parted ways with the office of Harris County District Attorney Sean Teare, according to a spokesperson's confirmation.
An organizational chart available on the district attorney’s website identifies Kabak as an assistant district attorney within the Special Victims Bureau, where he was responsible for litigating cases involving adult sex crimes. Records show that he worked in the domestic violence division in 2024, the last year of Kim Ogg's tenure as District Attorney.
In Texas, the offense of assault with family violence involving strangulation is classified as a felony, which may result in increased penalties if a conviction is secured.
Panorama Village police said the investigation remains ongoing. Further information regarding the purported incident has yet to be disclosed.
